The Standards of Conduct and Guidelines for Participation follow those established by the Collaborative Law Institute of Georgia and membership in the Institute is a criteria for membership in the Collaborative Law Center of Atlanta.

STANDARDS OF CONDUCT
(as suggested by the Agreement to Participate)

Written and verbal communications will be respectful and constructive and will not include accusations or claims which are not based in fact.

Communication during settlement meetings will be focused on the relevant issues relevant to the conflict and the constructive resolution of those issues.

When appropriate and needed, the parties will use member of an interdisciplinary team and/or neutral experts for purposes of emotional support and analysis valuation, cash flow analysis, and any other issue which requires expert advice and/or recommendations.  No attorney shall employ or allow his client to employ a private investigator during the Collaborative process or cause or allow surveillance of any party or otherwise allow or engage in the clandestine gathering of information during the collaborative process.

The parties and their lawyers agree to deal with each other in good faith to provide promptly all necessary and reasonable information requested.  No formal discovery procedures will be used unless specifically agreed to by the parties.

Neither party nor their lawyer will use the court during the Collaborative Law process unless it is mutually agreed.

Each attorney shall have the duty and obligation to withdraw his or her representation immediately upon learning that their client has failed to disclose pertinent information or has misrepresented a material fact.
