CL Professionals Maintain Integrity, Professionalism and Ethics

Professionals who practice Collaborative Family Law protect the privacy and dignity of all involved in the process. They uphold Standards of Conduct and, if inconsistencies and miscalculations occur, seek to correct them. Professionals commit to the process as well as its outcome. They receive special training and education that encourages mature, cooperative and non-combative behavior. They treat both parties as participants in the settlement team. The pledge not to take the case to court is formalized through a Participation Agreement.

Collaborative Law practitioners expend as much effort working toward settlement of a case as they would to prepare for and conduct a trial. As needed, they provide complete, honest and open disclosure of all relevant information with the required oaths and documentation. All practitioners are bound by the ethics that govern their particular profession. However, they usually do all of this without formal proceedings. When indicated, the Collaborative Law practitioner utilizes the interdisciplinary network of professionals to promote resolution of the case and support the parties in the process. If an impasse arises, they may bring in a neutral third party such as a mediator. The bottom line is that the team does whatever necessary to avoid the courtroom and resolve the issues, without sacrificing professionalism or ethical standards.

• Develop a member organization of trained professionals who are committed to Standards of Conduct and Guidelines for Participation.
• Establish marketing opportunities for members which will insure that clients in the metropolitan Atlanta area receive professional services devoted to negotiations free of the threat of trial.
• Provide members with a professional and efficient referral mechanism directed toward the Atlanta community.
